I always thought the difference was between hackers and 'crackers' (not the racist term).

There is, but then you get caught up in a terminology war over who is what, what is what, and so on. Think of it like in terms of musical genres having tons of sub-genres. In common mainstream terminology though, 'hackers' is pretty inclusive of anyone and everyone, good or bad.

People who's sole purpose in life is to hack into people's networks and destroy things.

Fortunately those are the stupid ones who get caught most of the time. Unfortunately, the worse of the bunch (cyber-crime groups, cyber-terrorists) are much more difficult to catch, or even prosecute if caught.

Actually it is very simple. Since the hacker is Polish he falls under Polish jurisdiction and laws. Those say:

In Polish law there are two charges possible:
1. Unauthorized access to data, which he obviously did.
2. Unauthorized data damage, alteration or deletion.

So clearly he committed a crime (actually at least two) and thus he is a a criminal hacker.

Ditto on the thanks, and I am trying so hard to be patient. I've actually worked 8 hours for 2 days in a row, assembled a coffee table, balanced my checkbook, done 3 loads of laundry, and given myself an awfully fancy manicure. I'm ready to get back to the important work of milking domesticated mouflon.
