In game OOC whispers
Whispering has been used for OOC reasons a lot of the time (asking questions etc.), but now that there is a chance that whispering will be heard by someone else, maybe there should be a special ooc whisper thing that you trust good rpers to use only when real ooc help is needed. There are quite a few flaws with this idea, but just throwing it out there for possible debate.

Better to overhear the occasional OOC whisper than to have the system abused.

I honestly don't see a point to this.
I am glad to be able to agree with Dudel.

Without warning.

So we're basically crippling one mode of communication and add a new one as a crutch for special purposes. Sounds perfectly sensible to me. (Sorry for sounding sarcastic, but I am.)
Besides, shouldn't we wait for the final implementation of this overhearing feature before thinking about ways to patch its flaws? Otherwise we might find solutions for problems that won't be problems anymore in a week or two.

Pretty in pink.

That's indeed a point. And OOCing in the open might be frowned upon because some people feel it reduces the immersion. (Still people could send a very short ooc message to everybody, explaining that the whisper was ooc help, if they feel it a big enough issue.)
So, are you going to put a little OOC checkbox in the whisper menu that hides the event from everybody but the recipient and sends a copy to PD so that they might check it?
Oh, and I don't think it should be bannable on the first offence. Mistakes happen.

Checkbox:
OOC-MESSAGE? []
Easy to see enough. Mistake? Ban. (Perhaps make it clickable with an even better explanation.
