A while ago a char of someone got captured by my char and some others he wanted to be killed but we refused, today he said with OOC he refuses to rp with us and no longer will look at that char.

I don't think that's necessarily a CRB. If the player finds the situation disturbing or depressing, they should have a right to let go of the character. A lot of people do that but they normally don't bother to announce it.

There is nothing wrong with the situation in terms of disturbing. The char is locked and not getting out.

Maybe it is a powergamer, and (s)he thinks like this;
"Locked up..? Lost the game."

It doesn't so much bother me that he gives up it bothers me he said it in OOC.
This is what the person said:
ooc: I won't be checking back in."
ooc: (name of the person) is done. I refuse to RP with chimps."

This he same annoyance that was going to "have a heart attack" in the character if he was locked up? X|
If SO I was going to report it THEN but there was no direct CRB only implication.

Calling people chimps is certainly rude, but you can't go inside someone's head and tell what they find disturbing. Even if nothing was said, a player could still find the situation disturbing in general.

As I see it, it's only a CRB if he is trying to influence you OOCly to let the char go. If it's just a comment, well, it's pointless but otherwise harmless, unless, indeed, you do act on it.

This person might try to influence me with saying that in ooc because maybe he or she hopes my char will kill him because he doesn't rp anymore. As that was the intention of that char all the time just to die.

If it is so determined to get killed it should attack your char and invoke him/her.

This person is doing that, well not attack as it won't help he is not armed. But a lot of insults.

Yes he should but he isn't and stopped role playing at all and won't check that char again.
